Hawaii trade name filing guide

Hawaii calls the DBA-style record a trade name. The current T-1 instructions define that expression as a name a person uses to identify a business or vocation and expressly say it is also called a doing-business-as or DBA name. Registration is available to an individual or an entity, including a corporation, partnership, limited liability company, limited liability partnership, unincorporated association, or another explained entity type. Hawaii law frames this certificate as voluntary: a person desiring registration may obtain it by following chapter 482. The certificate gives constructive statewide notice of the applicant's claim while the name remains in actual use, but the form warns that registration does not grant ownership of the trade name. This is not the formation form for a new corporation, partnership, or LLC, and it cannot safely be presented as trademark ownership. The responsible office is the Department of Commerce and Consumer Affairs, Business Registration Division, with Hawaii Business Express as the official online route. A registrant should therefore separate three decisions: formation of an entity, registration of a business trade name, and registration of a product trademark or service mark. Each uses different records even though DCCA presents the programs together.

Use the current November 2025 T-1 application and its matching instructions. The applicant first identifies whether the filing is new or a renewal, supplies the complete trade name, and identifies whether the applicant is an individual or entity. An entity gives its formation jurisdiction and Hawaii file number when registered in Hawaii; the form then asks for the applicant's business address, whether the applicant originated or received the name by assignment, and the nature of business conducted under the name. Submit online through Hawaii Business Express, or follow DCCA's paper instructions. The current authority page accepts paper filings at its service window and by email, mail, or fax. It directs mailed forms and payment to P.O. Box 40, Honolulu, and in-person delivery to 335 Merchant Street, Room 201. The nonrefundable filing fee is $50. Optional expedited review costs an additional $20 and is not part of the ordinary fee shown here. Email or fax delivery requires the payment information specified by DCCA, so use the authority's current secure procedure rather than sending card data anywhere else. Review the form for completeness, legibility, signature, and the correct new-or-renewal choice before submission. The office, not this guide, determines whether the name can be registered.

The current T-1 instructions quote Hawaii Revised Statutes section 482-3: a trade-name certificate has a five-year term from its date, provided the applicant continues actual use in Hawaii. Renewal is available for additional five-year periods. The renewal application must be filed within the six months before the current term expires, and the current instructions state a $50 renewal fee. Do not confuse that window with a five-year grace period; it is the advance filing period tied to the certificate's expiration. DCCA's forms page separately identifies a registrant-name change letter, an assignment form, and cancellation routes. Cancellation uses a signed request and may be sent by email, fax, mail, or delivery to the Business Registration Division. A name change, assignment, cancellation, and renewal are different actions and should be selected according to what changed. Hawaii law also makes a certificate subject to revocation after 365 consecutive days of nonuse, so continued actual use matters to more than the printed end date. Retain the issued certificate and use its actual date when calculating the renewal window instead of estimating from the application date.

Decide first whether the goal is voluntary statewide notice for an existing trade name or formation of a new legal entity. For the trade-name record, open the DCCA T-1 instructions and current form together, then choose Hawaii Business Express or one of the published paper-delivery methods. Confirm that the applicant is the originator or assignee of the name, select the correct individual or entity status, and preserve the filed certificate. Calendar the five-year end date shown on the certificate and begin any renewal within the six months before it expires. If the registrant's name changes, use the specific name-change letter; if ownership of the name is assigned, use the assignment path; if use ends, submit the signed cancellation request rather than assuming the record disappears. Registration does not establish ownership against every competing claimant, so do not advertise it as a trademark decision.
